These Terms & Conditions (“Terms”) govern your access to and use of the ECOMO website, mobile application, and ride-sharing services in Nepal.
By registering, accessing, or using our Services, you agree to be bound by these Terms.
1. Use of the Platform
You agree to use the ECOMO platform only for lawful purposes and in accordance with these Terms.
You must not:
- Misuse or disrupt the platform, app, or services
- Create false accounts or impersonate others
- Attempt unauthorized access to systems or data
- Engage in abusive, threatening, or unsafe behaviour toward staff or passengers
- Use the service for illegal activities or the transport of prohibited items
We reserve the right to restrict or suspend access to any user violating these Terms.
2. Services Overview
ECOMO is a licensed ride-sharing service provider operating a private fleet of vehicles in Nepal. All rides are provided by ECOMO directly through its owned vehicles and company-employed drivers.
Our services include:
- On-demand ride-hailing services
- Fleet-based dispatch, scheduling, and trip routing
- Fare estimation, billing, and payment processing (cash and digital payments)
- Employment, training, supervision, and management of drivers
- Vehicle ownership/lease management, maintenance, and safety compliance
- Customer support, complaint handling, and service quality monitoring
- Ratings and feedback systems to improve service standards
All transportation services are directly provided by ECOMO, and drivers operate as employees of the company under its supervision and control.
3. Eligibility
To use our services, you must:
- Be at least 16 years of age
- Provide accurate and complete registration details
- Have a valid phone number and device access
- Comply with all applicable laws of Nepal
We may refuse or terminate service where eligibility requirements are not met.
4. Account Registration and Security
You are responsible for:
- Maintaining confidentiality of your account
- All activities performed through your account
- Promptly notifying us of any unauthorized access
We may suspend accounts that show suspicious or fraudulent activity.
5. Company Drivers and Fleet Operations
All drivers operating under ECOMO are employees under full operational control of the company.
We are responsible for:
- Driver recruitment, background checks, and training
- Ensuring valid driving licenses and compliance with Nepal transport laws
- Vehicle ownership, leasing, inspection, and maintenance
- Monitoring driver performance, safety, and conduct
Drivers are required to:
- Follow all traffic laws and safety rules
- Maintain professional conduct with passengers
- Follow company operational policies and training guidelines
We may take disciplinary action, including suspension or termination, for misconduct or safety violations.
6. Payments and Pricing
ECOMO supports cash and digital payment methods available in Nepal.
By using our services, you agree that:
- All fares, fees, and charges must be paid in full
- Pricing may vary based on distance, time, demand, or service type
- Additional charges may apply
- Discounts and promotions are subject to specific terms and may be modified or withdrawn
We reserve the right to update pricing structures at any time.
7. User Conduct and Safety Rules
For safety and service quality:
- Passengers must behave respectfully toward drivers and staff
- Smoking, alcohol consumption, or illegal activity inside vehicles is prohibited
- Transport of illegal, hazardous, or restricted items is not allowed
- Seatbelts must be worn where applicable
- Drivers and passengers must follow safety instructions during trips
We may refuse service where safety or law is at risk.
8. Ratings, Feedback, and Monitoring
Passengers may provide ratings and feedback after each trip.
We use this information to:
- Improve service quality
- Monitor driver performance
- Investigate complaints or disputes
We reserve the right to investigate misuse or manipulation of ratings.
9. Cancellations and Refunds
- Riders may cancel bookings, subject to applicable cancellation charges
- Refunds, if applicable, will be processed based on internal policy
- Disputes will be reviewed by our support team
10. Intellectual Property
All content on the platform—including logos, branding, software, design, text, and graphics—is owned by or licensed to ECOMO.
You may not:
- Copy, modify, or distribute platform content without permission
- Use our brand or assets for unauthorized purposes
- Reverse engineer or attempt to extract system code
11. User Content
Any content you submit (feedback, reviews, messages) may be used by ECOMO for:
- Service improvement
- Customer support
- Operational analysis
- Marketing and communication (where legally permitted)
You retain ownership of your content but grant us a license to use it for service-related purposes.
12. Limitation of Liability
To the fullest extent permitted under Nepal law:
- ECOMO provides ride-sharing services through its own fleet
- We are responsible for service delivery within reasonable operational limits
- We are not liable for indirect or incidental damages
- We are not responsible for delays caused by traffic, weather, or external conditions
- Use of services is at your own reasonable risk
Nothing in these Terms excludes liability where it cannot be excluded under applicable law.
13. No Warranty
Services are provided on an “as available” basis.
We do not guarantee:
- Continuous or error-free service
- Availability of vehicles at all times
- Accuracy of estimated arrival times in all conditions
14. External Links
Our platform may contain links to third-party websites or services. We are not responsible for their content, policies, or practices.
15. Suspension and Termination
We may suspend or terminate access to services if:
- You violate these Terms
- You engage in unsafe or abusive behavior
- Required by law or government authority
- Fraud or misuse is detected
Users may stop using the service at any time.
16. Changes to Terms
We may update these Terms from time to time. Changes will be posted with an updated “Last Updated” date.
Continued use of the service means acceptance of updated Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Nepal.
Any disputes shall be subject to the jurisdiction of the competent courts of Nepal.
